Under current law, foreign workers who enter the country under the H-1B, high-skilled guest worker program can stay and work in the United States for up to six years. In some cases, employers will apply for an employment-based green card on behalf of the H-1B workers, allowing them to stay in the U.S. permanently. But many of these green cards are not issued within the six-year window because of annual caps and per-country limits imposed by Congress. Congress intentionally set these limits to help protect American workers.
The proposed rule, however, would allow an H-1B worker whose employer has applied for a green card on their behalf to stay and work in the United States beyond the six-year limit even if they've yet to receive a green card.
